1. About myMoneyCA
myMoneyCA LLC ("myMoneyCA", "we", "us") is a California limited liability company operating an unclaimed property search and claims filing service for California residents. We help individuals locate unclaimed property held by the California State Controller's Office (SCO) and assist with the claims filing process. myMoneyCA is not affiliated with, endorsed by, or operated by the California State Controller's Office.
2. Services We Provide
myMoneyCA provides the following services:
- Property Search: Search our database of unclaimed property records sourced from the California State Controller's Office.
- Claims Filing Service: For eligible claims of $25 or more, we prepare your forms, initiate your claim, and file all required documents with the SCO on your behalf as a registered California unclaimed property investigator.
- Account Management: Track the status of your claims through your myMoneyCA dashboard.
For unclaimed property valued under $25, we will direct you to the SCO's free self-service portal at claimit.ca.gov at no charge.
3. Fee Agreement — Full Terms
When you start a claim with myMoneyCA, you enter into the Unclaimed Property Recovery Services Agreement reproduced in full below. This Agreement has been reviewed by licensed California counsel and is incorporated into these Terms of Service by reference.
- Your information is protected. We collect your Social Security Number, date of birth, and government ID only to file your claim with the California State Controller. We don't sell or share it.
- No recovery, no fee. If the State Controller denies your claim, you owe us nothing. We will appeal once at no additional cost.
- Our fee is 10% of what the State approves. The State issues two separate checks — 90% to you, 10% to myMoneyCA. You never pay us directly.
- Some reductions are out of our control. Child support, back taxes, or other government debts may reduce your portion of the State's check. That does not affect our fee.
Clause 1: Authorization to Collect and Submit Sensitive Personal Information
Client authorizes myMoneyCA LLC to collect the following Sensitive Personal Information strictly as necessary to perform this Agreement and in compliance with applicable law, including the California Consumer Privacy Act and its regulations: the Client's Social Security Number, date of birth, and government-issued identification.
The Client authorizes myMoneyCA LLC to submit that Sensitive Personal Information to the California State Controller's Office (the "SCO") solely for the purpose of filing and processing the Client's unclaimed property claim, subject to reasonable security measures and transmission methods consistent with industry standards.
myMoneyCA LLC will not use that Sensitive Personal Information for any purpose other than SCO claim filing, and will not sell or share such information as those terms are defined under the California Consumer Privacy Act. The Client acknowledges that this information is required for myMoneyCA LLC to file the claim on the Client's behalf under this Agreement and consents to the creation, retention, and destruction of such information in accordance with myMoneyCA LLC's records retention policy and applicable law.
Clause 2: SCO Denial, Appeal, and Termination of Obligation
If the SCO denies the Client's claim, no fee is owed to myMoneyCA LLC under this Agreement. myMoneyCA LLC will conduct one informal SCO Appeal on the Client's behalf at no additional charge, provided that the Client timely furnishes all information and documentation reasonably requested by myMoneyCA LLC.
If the SCO Appeal does not result in approval of the Client's claim, myMoneyCA LLC's obligations under this Agreement terminate in full, and Client shall remain responsible only for any governmental or third-party fees previously authorized in writing and actually incurred. myMoneyCA LLC has no obligation to pursue formal litigation, administrative hearings, or any further appeal beyond the one informal SCO Appeal described in this clause, and makes no guarantee of outcome.
Clause 3: Fee Calculation and Warrant Issuance
myMoneyCA LLC's fee equals ten percent (10%) of the Gross Warrant Amount in compliance with California Code of Civil Procedure §1582(a)(2)(C). The Gross Warrant Amount is the total value of the unclaimed property recovery as reflected in the warrant issued by the SCO at the time of approval, before any reduction by government intercepts, tax liens, child support levies, garnishments, or any other third-party encumbrances, and excludes any interest or penalties not included in the SCO's warrant.
The SCO issues two separate warrants simultaneously upon approval of the claim: one warrant payable directly to myMoneyCA LLC in the amount of ten percent (10%) of the Gross Warrant Amount, and one warrant payable directly to the Client in the amount of ninety percent (90%) of the Gross Warrant Amount. myMoneyCA LLC's fee is earned, due, and payable at the moment the SCO issues a warrant.
The fee is not contingent on the amount the Client ultimately receives after any third-party reduction to the Client's ninety percent (90%) warrant, and the Client waives and releases any claim to offset or withhold payment based on such reductions.
Clause 4: Disclaimer of Liability for Third-Party Encumbrances
myMoneyCA LLC has no control over and bears no responsibility for any liens, levies, garnishments, child support intercepts, Franchise Tax Board intercepts, tax liens, or any other third-party encumbrances that may reduce the Client's Net Recovery from the Client's ninety percent (90%) SCO warrant, and the Client agrees not to assert any claim against myMoneyCA LLC arising from or relating to such reductions.
The Client's Net Recovery is the amount the Client actually receives after the application of any third-party encumbrances to the Client's ninety percent (90%) warrant. The Client's Net Recovery may be less than the Client's ninety percent (90%) share of the Gross Warrant Amount through no action or fault of myMoneyCA LLC.
Child support intercepts are imposed by operation of California Family Code §17522. Franchise Tax Board intercepts are imposed by operation of California Revenue and Taxation Code §18670. Both intercept mechanisms are entirely outside myMoneyCA LLC's control. The Client affirmatively acknowledges these conditions and agrees that myMoneyCA LLC bears no liability for any reduction in the Client's Net Recovery caused by third-party encumbrances, and the Client shall cooperate in complying with any statutory intercept process and provide prompt notice to myMoneyCA LLC of any related communications.
Definitions
"Agreement" means this Unclaimed Property Recovery Services Agreement between myMoneyCA LLC and the Client, including all clauses, schedules, and any written amendments.
"Client" means the individual or entity on whose behalf myMoneyCA LLC is authorized to pursue an unclaimed property claim with the SCO.
"myMoneyCA LLC" means myMoneyCA LLC, together with its employees and agents acting within the scope of this Agreement.
"Sensitive Personal Information" means Social Security Number, date of birth, and government-issued identification document provided by the Client to myMoneyCA LLC under this Agreement.
"SCO" means the California State Controller's Office.
"Claim" means the Client's unclaimed property claim submitted to the SCO through myMoneyCA LLC under this Agreement, including any related correspondence and evidentiary submissions.
"Gross Warrant Amount" means the total value of the unclaimed property recovery as reflected in the warrant issued by the SCO at the time of approval, before any reduction by government intercepts, tax liens, child support levies, garnishments, or other third-party encumbrances, and excluding any interest or penalties not included in the SCO's warrant.
"Net Recovery" means the amount the Client actually receives after application of any third-party encumbrances to the Client's ninety percent (90%) SCO warrant.
"Informal SCO Appeal" means a written or electronic request for reconsideration or supplementation submitted to the SCO following an initial denial of the Claim, excluding any formal litigation, administrative hearing, or judicial review.
"Fee" means the amount payable to myMoneyCA LLC equal to ten percent (10%) of the Gross Warrant Amount, earned, due, and payable upon issuance of the SCO warrant(s) approving the Claim.
"Government Intercepts" means statutorily authorized deductions or offsets against the Client's recovery, including without limitation child support intercepts under California Family Code §17522 and Franchise Tax Board intercepts under California Revenue and Taxation Code §18670.
"Business Day" means any day other than a Saturday, Sunday, or a day on which banks in the State of California are authorized by law to be closed.
"Applicable Law" means all federal, state, and local laws, regulations, and governmental orders applicable to the collection, use, disclosure, transmission, retention, and destruction of Sensitive Personal Information and to the services provided under this Agreement, including the California Consumer Privacy Act and its implementing regulations.
"Records Retention Policy" means myMoneyCA LLC's written information governance policy governing the retention and destruction of records, including Sensitive Personal Information, as updated from time to time in compliance with Applicable Law.
7. Your Responsibilities
By using myMoneyCA, you agree to:
- Provide accurate, complete, and truthful information about yourself and any claims you submit.
- Cooperate with myMoneyCA and the SCO in the claims process, including providing requested documentation.
- Notify myMoneyCA promptly of any changes to your contact information.
- Use our services only for lawful purposes and only to file claims for property you are legally entitled to.
8. Account Registration
To use certain features of myMoneyCA, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
9. Limitation of Liability
myMoneyCA provides claims filing assistance services and makes no guarantee of recovery. To the maximum extent permitted by law, myMoneyCA's total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the fees paid by you to myMoneyCA in the twelve months preceding the claim.
myMoneyCA is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
10. Privacy
Your use of myMoneyCA is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
11. Modifications to These Terms
myMoneyCA reserves the right to modify these Terms at any time. We will notify registered users of material changes by email or by posting a notice on our website. Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms.
12. Termination
myMoneyCA reserves the right to suspend or terminate your account at any time for violation of these Terms. You may close your account at any time, provided there are no active claims in progress. Active fee agreements remain binding after account closure.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Stanislaus County, California.
